Terms of Service

1. Scope

These Terms of Service govern the use of the website gewerber.de and the services of the Gewerber platform offered through it (app.gewerber.de), operated by DIP Dev, Development of Digital Innovative Products by Dmytro Prylutskyi, Dorfstraße 6, 85447 Grucking, Germany (hereinafter “Provider”).

For the use of the Gewerber app: to the extent that a contract for paid services is concluded, the conditions stated there apply supplementarily. Conflicting terms of the user do not become part of the contract.

2. Subject of the service

Gewerber is an open software platform for solo entrepreneurs and small businesses with the modules invoicing, time tracking, accounting and guidance through German bureaucracy. The core of the platform is open source; the source code is freely available at https://github.com/Gewerber and may be used under the licenses stated there.

The Provider may extend, modify or remove functions insofar as this is reasonable for the user and does not materially impair the contractually agreed core functions.

3. Registration and conclusion of contract

The use of certain functions (e.g. storage of invoices and time-tracking data) requires the registration of an account. The contract is concluded upon successful registration and confirmation by the Provider. The user is obliged to keep his access data secret and to ensure the security of his account.

4. User obligations

The user undertakes to use the services only in accordance with applicable law, not to upload unlawful content and not to impair the security of the platform. Security vulnerabilities must be reported to the Provider confidentially (info@dipdev.de).

5. Availability and data

The Provider strives for availability that is as uninterrupted as possible, but does not guarantee any specific availability unless expressly agreed otherwise. The user is himself responsible for backing up his data; the Provider additionally carries out appropriate backup measures.

6. Prices and small business regulation

The Provider is exempt from sales tax pursuant to § 19 UStG. To the extent that paid services are offered, prices are stated without sales tax; no sales tax is shown.

7. Liability

The Provider is liable without limitation in cases of intent and gross negligence and in cases of injury to life, body or health. In cases of slightly negligent breach of essential contractual obligations (cardinal obligations), liability is limited to the foreseeable damage typical for the contract. Otherwise, liability for slight negligence is excluded.

8. Intellectual property

The contents of the website (texts, graphics, logos, brands) are subject to copyright and trademark law. The open-source components may be used freely within the scope of the respective license.

9. Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. To the extent legally permissible, the place of jurisdiction for all disputes arising from this contract is the registered office of the Provider. Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
